Terms of service

Last updated: 3 October 2026

1. Who we are and these Terms

BabiFable is operated by Brownlie Creative Pty Ltd, trading as BabiFable, ABN 68 702 223 005, ACN 702 223 005. Contact us at hello@babifable.com.

These Terms apply to the BabiFable app, website and related services. When you create an account or purchase a product or service, you agree to the Terms presented to you. Relevant product descriptions and purchase terms also apply. Our Privacy Policy explains information handling separately.

Provisions about subscriptions, digital purchases and printed books apply only when we offer those products and you purchase them. Mentioning a feature in these Terms does not mean it is currently available.

2. Accounts and authority

Account holders must be at least 18 and able to enter a binding agreement. Provide accurate account information, keep credentials secure and tell us promptly about suspected unauthorised access.

Use only accounts and family profiles you are authorised to access. You must have the necessary rights and authority to add or share information about a child or another person. App roles and relationship labels do not establish legal guardianship.

3. Family access and disputes

Authorised caregivers can view or contribute to shared profiles according to their permissions. Only invite people entitled to access the information, and respect privacy, safety and any applicable court orders.

Where there is a credible access or authority dispute, we may temporarily restrict affected access or changes while we reasonably assess the issue. We will take proportionate steps and explain our decision where lawful and safe. BabiFable does not determine custody or replace a court or emergency service.

4. Health and safety

BabiFable is a family recordkeeping and memory service. It does not provide diagnosis, treatment or professional healthcare advice, and records are not continuously monitored by a clinician.

Reminders, colour indicators, summaries and feeding or sleep estimates may be incomplete, delayed or incorrect. Do not use them as the sole basis for a health decision or delay seeking qualified advice. In an emergency, contact emergency services.

These warnings do not remove rights or responsibilities that cannot be excluded by law.

5. Your content

You retain your rights in the photos, stories and other content you provide, subject to other people's rights. You must have permission to upload, share and, where relevant, print that content.

You give us a non-exclusive, royalty-free licence to store, reproduce, process, format, synchronise and display your content only as needed to provide, secure and support the services you request, including authorised family sharing and book production. The licence operates worldwide because our providers may operate overseas. We may authorise service providers to carry out those tasks for us, but not to use your content for unrelated purposes.

This licence does not transfer ownership or give us permission to use private family content in advertising. It ends when the relevant content is deleted, except for limited continued handling permitted by law and explained in our Privacy Policy.

6. Acceptable use and our intellectual property

Do not misuse another person's information, bypass security, gain unauthorised access, upload unlawful or rights-infringing content, introduce malware, disrupt the service or commercially exploit another family's information.

BabiFable and its licensors own the software, branding, designs and templates, excluding your content. You may use them for the intended personal and family purposes of the service, including creating and gifting your own books. You may not resell our templates or copy or distribute our software except where permitted by law.

7. Prices and payment

The applicable price, currency, included features and any delivery charges or applicable taxes will be shown before you pay. A subscription does not include a printed book unless the offer expressly says so.

Payments are processed through the checkout or app-store provider you choose. Our online store is hosted by Shopify, which processes information associated with visits, checkout and purchases as described in our Privacy Policy and Shopify's own privacy terms.

For an obvious pricing or product-description error, we will contact you before proceeding on corrected terms. You may decline the correction and receive a refund of any payment for the affected unfulfilled purchase. We will not impose a higher price without your agreement.

8. Subscriptions and digital purchases

Paid features and subscription terms are disclosed before purchase. Our Subscription Policy (https://babifable.com/policies/subscription-policy) explains renewal and cancellation. Our Refund, Return and Cancellation Policy (https://babifable.com/policies/refund-policy) explains refunds and consumer remedies.

You must actively choose a paid offer; opening a free account does not itself authorise a charge. App-store purchases are also subject to the applicable platform's billing rules, without limiting rights that cannot be excluded by law.

9. Personalised books

Before placing an order, check the book preview and selected specifications, including names, spelling, dates, text, photos, cropping, layout, page order and delivery details. We do not promise to proofread or edit your content unless that service is expressly included.

A preview represents the design, not an exact reproduction of paper, screen colour or print finish. Reasonable production variations may occur, but the finished product must still meet its description and applicable consumer guarantees. Preview approval does not excuse our errors or defects.

Once production starts, a personalised book may not be changeable or cancellable for change of mind. Please contact us immediately about a requested change. The Refund, Return and Cancellation Policy and Shipping Policy (https://babifable.com/policies/shipping-policy) apply.

10. Availability and your copies

Internet connections, devices, maintenance and provider interruptions can affect availability, synchronisation and notifications. Keep independent copies of irreplaceable photos and information needed for urgent care or long-term preservation.

Do not clear local app data or uninstall the app to resolve a synchronisation problem before saving important unsynchronised information or contacting support. This advice does not exclude our legal responsibility for the service.

We may improve or change features. For changes materially disadvantaging a paid customer, we will give reasonable advance notice where practicable and provide any cancellation, refund or other remedy required by law. Where a service is being discontinued, we will provide a reasonable opportunity to retrieve available content where lawful and practicable.

11. Suspension and ending your account

You may stop using the service, cancel a subscription or request account deletion. These are separate actions; see the relevant policies for their effects.

We may restrict access where reasonably necessary to address a material breach, security incident, unlawful activity or a serious safety concern. Action will be proportionate. Except where urgent action is justified or notice is prohibited, we will explain the issue and give a reasonable opportunity to respond before permanent termination.

You may ask hello@babifable.com to review an access decision. Suspension or termination does not remove any refund or other rights you have under law.

12. Consumer rights and responsibility

Nothing in these Terms excludes or restricts rights, guarantees or remedies that cannot lawfully be excluded, including under the Australian Consumer Law.

Our responsibility for our products and services, and your entitlement to remedies or compensation, are determined by applicable law. Descriptions of service limitations and requests to keep your own copies do not waive those rights. You remain responsible for your own unlawful conduct and content to the extent provided by law.

13. Changes and disputes

We may update these Terms and will provide appropriate notice of material changes. Changes will not retrospectively remove rights relating to an existing purchase. Where required, we will seek agreement to new terms.

These Terms are governed by the laws of Victoria, Australia, subject to mandatory protections applying elsewhere. You are not prevented from using a court, tribunal, regulator or consumer body that has jurisdiction.

Please contact hello@babifable.com about a concern so we can try to resolve it. Contacting us is not a requirement that removes or delays your right to pursue other available remedies.
